Holiday Marketing Challenge Day Ten: Play Holiday Music

This post will be brief and may concern something you’re already doing. In addition to making your business look and smell like Christmas, have it sound like it too! Most customers look forward to hearing Christmas songs when they’re shopping during the holiday season. Playing holiday music is sure to keep your customers smiling!

Things to Know

While conducting research for this article, I stumbled upon some interesting copyright laws that need to be obeyed. I was unfamiliar with these laws and I’m willing to bet some of you are as well. So before you run to the radio and black “Jingle Bells,” there are few things you need to know.

You Need a License to Play Music

I strongly recommend you double check the size of your establishment and even consult legal experts or a fellow business owner before you start jamming. As a rule of thumb, if your business is under 2,000 square feet, or if your bar/restaurant is under 3,750 feet, you do not need a license to play music. There are at least three different companies from whom you can attain licenses. It all depends on which artists you would like to play.

If you’re already licensed, this part is probably old news for you. However, if you are not licensed but would like to play music, or do not have a license and were unaware of the law, I would highly recommended doing some of your own research. The last thing you need is a copyright violation.

The Rules Are Different for Radio

Again, laws very from copyright company to copyright company and from state to state. However, the general rule is that playing a radio in a small business is not likely to violate the copyright laws, as these mainly apply to live performances, internet radio, and MP3 files on a computer. If you tune your radio to the station that plays Christmas music during the holiday season, and your business is under 2,000 square feet, you’re pretty safe.

Fun and Safe Holiday

Double check to make sure you do not need a license for the music you’re playing. We certainly don’t want to discourage anyone from playing music in their store. However, we really don’t want someone to pay a fine for copyright infringement either.
